LearnerLens Terms & Conditions

Welcome to LearnerLens. These Terms & Conditions govern your access to and use of the LearnerLens website, forms, services, reports, and related digital deliverables. By using the website, submitting information, ticking an agreement box, or purchasing a service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the website or purchase any LearnerLens service.

1. Definitions

For the purposes of these Terms:

“LearnerLens,” “we,” “our,” or “us” refers to LearnerLens and its owner(s), operator(s), contractor(s), and authorised representatives.

“Service” means any LearnerLens report, learner profile, roadmap, add-on, template, summary, guide, email support, form, or related digital deliverable.

“Customer” means the person purchasing or requesting a Service.

“Learner” means the child or individual the Service relates to.

“Website” means the LearnerLens website, landing pages, forms, checkout flows, communications, and any related online systems.

2. Acceptance of Terms

By accessing the Website, submitting information, completing a form, ticking an agreement checkbox, making payment, or using a LearnerLens Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

 

If you are entering into these Terms on behalf of a learner under 18, you confirm that you are the parent, legal guardian, or otherwise authorized to do so.

3. Nature of the Service

LearnerLens provides educational and informational insight services intended to support parent understanding, learning support planning, and practical next steps.

Our Services are:

  • educational and informational in nature

  • non-clinical and non-diagnostic

  • not medical, psychiatric, psychological, therapeutic, counselling, or legal services

  • not a substitute for formal evaluation, diagnosis, treatment, or professional care

LearnerLens reports are based on the information submitted by the Customer and may include educational interpretation, observations, summaries, and practical support suggestions. They do not include standardised testing unless expressly stated otherwise.

4. No Diagnosis; No Professional Relationship

LearnerLens does not diagnose, confirm, rule out, or treat any medical, psychological, psychiatric, neurological, developmental, behavioural, or learning condition.

This includes, without limitation, conditions such as ADHD, dyslexia, dyscalculia, autism, anxiety, depression, or any other disorder or diagnosis.

Use of the Website or Service does not create any professional-client, therapist-patient, doctor-patient, psychologist-client, attorney-client, fiduciary, or similar regulated professional relationship.

5. Not for Emergencies or Crisis Situations

LearnerLens is not an emergency service. If you believe a person is at immediate risk of harm, abuse, self-harm, or crisis, you must contact local emergency services immediately. We do not monitor submissions in real time and cannot provide urgent intervention.

6. Intended Use of Reports

LearnerLens reports are intended for personal educational insight and optional supportive sharing with teachers, tutors, schools, or allied professionals at the Customer’s discretion.

LearnerLens reports:

  • are not official academic, medical, legal, or psychological documents

  • are not formal assessments, certifications, or diagnoses

  • must not be used as a substitute for professional assessment or treatment

  • must not be relied on for high-stakes decisions, including medical, legal, disciplinary, employment, school placement, or litigation matters

Any third party who receives or reviews a LearnerLens report may interpret it differently. LearnerLens is not responsible for any third-party decision, response, interpretation, or action.

7. No Guarantee of Outcomes

While LearnerLens aims to provide thoughtful, useful, and high-quality educational insight, we do not guarantee any specific result, improvement, outcome, or benefit.

This includes, without limitation:

  • academic improvement

  • behavioural improvement

  • school admissions or placement outcomes

  • third-party acceptance of the report

  • eligibility for accommodations, support services, or funding

  • any particular educational or developmental outcome

8. Customer Responsibilities

You agree to provide complete, lawful, accurate, and honest information in good faith.

You are responsible for:

  • ensuring that all information submitted is truthful and not misleading

  • ensuring that you have the legal right to submit the learner’s information

  • reviewing all information before submission

  • providing a valid email address and up-to-date contact information

  • checking your spam or junk folders for communications or delivery

The quality, usefulness, and accuracy of a LearnerLens report depend significantly on the accuracy and completeness of the information you provide. LearnerLens is not responsible for errors, omissions, or limitations arising from incomplete, inaccurate, outdated, or misleading input.

9. Right to Refuse or Cancel a Service

LearnerLens reserves the right to refuse, decline, pause, or cancel any order or request at our discretion before work begins, including where:

  • the submission is incomplete or unclear

  • the request falls outside the scope of our Services

  • the information raises safeguarding or ethical concerns

  • abusive, threatening, fraudulent, or inappropriate conduct is involved

  • we reasonably believe the Service is not suitable for the stated purpose

If we cancel an order before work begins, we may issue a refund at our discretion, subject to any unrecoverable processing or administrative costs.

10. Fees, Payment, and Taxes

All prices are displayed on the Website, at checkout, or by written quotation.

Payment must be made in full before work begins unless we expressly agree otherwise in writing.

You are responsible for any taxes, VAT, duties, levies, or charges that may apply in your jurisdiction.

If a payment fails, is reversed, is disputed, or is charged back after work has begun or after delivery, LearnerLens reserves the right to dispute the reversal and provide supporting records, including proof of order, checkbox acceptance, email delivery records, timestamps, and work completed.

11. Digital Product Policy; Refunds

LearnerLens Services are customised digital services and digital products.

Due to the personalised nature of the work:

  • no refunds will be provided once work has begun

  • no refunds will be provided once a report or digital deliverable has been generated, drafted, prepared, or delivered

  • no refund will be provided due to disagreement with educational interpretation where the report was produced in good faith from the information submitted

If a technical error occurs due to our systems, we will make reasonable efforts to correct the issue.

Nothing in this clause removes any rights that cannot legally be excluded under applicable consumer protection law.

12. Revisions and Clarifications

Unless otherwise stated in writing, one reasonable clarification request may be submitted within 7 days of delivery.

This may be limited to:

  • correcting factual errors caused by incorrect or incomplete submitted information once corrected information is supplied

  • clarifying wording in the report

  • correcting obvious formatting or administrative mistakes

This does not include:

  • a complete rewrite

  • a new report based on new information submitted after delivery

  • changes in opinion after delivery

  • expansion into diagnostic or professional assessment services

Any additional revisions may be charged separately at our discretion.

13. Delivery Timeframes

Any stated delivery timeframe is an estimate only unless expressly stated as guaranteed in writing.

Delivery times may vary due to workload, complexity, public holidays, technology issues, payment delays, incomplete submissions, or unforeseen events.

LearnerLens will make reasonable efforts to deliver within the estimated timeframe and to communicate substantial delays where practical.

14. Email Delivery and Customer Access

Reports and communications are typically delivered electronically.

You are responsible for:

  • providing the correct email address

  • ensuring your email account can receive attachments or links

  • checking spam, junk, promotions, and filtered folders

  • contacting us within a reasonable time if expected delivery has not been received

LearnerLens is not responsible for delivery issues caused by incorrect email addresses, full inboxes, spam filters, security restrictions, or customer-side technical problems.

15. Intellectual Property

All LearnerLens materials, including but not limited to report structures, frameworks, templates, layout, wording, design elements, scoring logic, methods, guides, downloads, and digital materials, remain the intellectual property of LearnerLens unless expressly stated otherwise. 

You may use the delivered report for your own personal, non-commercial use.

You may not, without prior written permission:

  • reproduce, publish, resell, license, distribute, or commercially exploit LearnerLens materials

  • remove branding, disclaimers, or explanatory notes

  • copy or adapt the structure, language, or presentation of the Service for resale

  • claim LearnerLens materials as your own

16. Prohibited Uses

You agree not to:

  • represent a LearnerLens report as a diagnosis, assessment, or regulated professional opinion

  • use the Service for unlawful, abusive, harmful, or fraudulent purposes

  • use the report as legal evidence, in litigation, or in formal disputes, claims, or complaints

  • use the report to harass, pressure, defame, or intimidate schools, professionals, institutions, or individuals

  • alter the report in a way that changes its meaning

  • scrape, reverse engineer, extract, copy, or misuse the Service or Website

  • impersonate another person or submit information without lawful authority

17. Privacy and Data Protection

Your use of LearnerLens is also governed by our Privacy Policy, which forms part of these Terms.

By using the Service, you acknowledge that personal information may be collected, stored, processed, and used for purposes including:

  • providing the Service

  • communicating with you

  • maintaining business records

  • improving operational quality

  • meeting legal or regulatory obligations

You confirm that you have the lawful right to share any learner information you submit.

18. Minors and Consent

If the learner is under 18, you confirm that you are the learner’s parent, legal guardian, or otherwise legally authorized to provide their information and request the Service. 

Where learner participation is requested, it must be voluntary and age-appropriate, and may be supported by an adult where necessary.

19. Disclaimer of Warranties

To the maximum extent permitted by law, the Website and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

We do not warrant that:

  • the Service will meet every expectation or purpose

  • the Website will be uninterrupted, error-free, or always available

  • the report will be accepted by third parties

  • the Service will produce any guaranteed result or outcome

20. Limitation of Liability

To the maximum extent permitted by law, LearnerLens and its owner(s), contractor(s), affiliates, service providers, and representatives shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, goodwill, opportunity, data, educational outcome, or business interruption arising from or related to use of the Website or Service.

Where liability cannot legally be excluded, LearnerLens’s total liability shall be limited to the amount actually paid by the Customer for the specific Service giving rise to the claim.

21. Indemnity

You agree to indemnify, defend, and hold harmless LearnerLens and its owner(s), contractor(s), affiliates, and representatives from and against any claims, actions, demands, losses, liabilities, costs, or expenses, including reasonable legal fees, arising from:

  • your misuse of the Website or Service

  • your breach of these Terms

  • your unlawful or unauthorised submission of information

  • your sharing or use of a report with third parties

  • any dispute arising from your reliance on, reinterpretation of, or misuse of the report

22. Safeguarding and Sensitive Concerns

LearnerLens may, at its discretion, decline or discontinue a Service where submitted information suggests urgent safeguarding concerns, serious risk, abuse concerns, or issues better handled by emergency, legal, clinical, or child-protection professionals.

LearnerLens does not undertake investigative, safeguarding, or emergency intervention duties through the Website or Service.

23. Suspension, Changes, or Withdrawal of Services

LearnerLens may update, change, suspend, or discontinue any part of the Website or Service at any time, with or without notice, including pricing, features, deliverables, and workflows.

We may also update these Terms from time to time. The version published on the Website at the time of purchase or order will generally apply to that order unless otherwise required by law.

24. Severability

If any part of these Terms is found to be unenforceable or invalid, that part will be severed and the remainder will remain in full force and effect.

25. Waiver

If we do not enforce a provision immediately, it does not mean we waive our right to enforce it later.

26. Entire Agreement

These Terms, together with the Privacy Policy and any express written service-specific terms provided at checkout or by email, form the entire agreement between you and LearnerLens in relation to the Service.

27. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of South Africa, unless otherwise required by mandatory consumer law in the Customer’s jurisdiction.

Before starting formal legal proceedings, both parties agree to first attempt to resolve any dispute informally by contacting the other party in writing and allowing a reasonable opportunity to respond.

Nothing in these Terms removes any rights that cannot legally be excluded under applicable law.
